Srinagar, Jan 9: High Court today directed the authorities to repatriate a man to his native country within a period of six weeks in terms of applicable laws.
Justice Ali Mohammad Magrey while disposing of the petition of one Qari Mohammad Ismail who is presently lodged in Central Jail Srinagar under the provisions of Public Safety Act, directed all concerned authorities to ensure his deportation in view of applicable laws. “The petition is disposed of with the direction to all the respondents to ensure deportation of the detenue in terms of the applicable laws”, court directed.
Justice Magrey directed that necessary orders about his deportation shall be passed within a period of six week and till that time his lodgment shall not be changed.
The direction of repatriation of the detenue has been passed after the union counsel submitted before the court that the instant case shall be considered on the recommendation of the State for repatriation of the detenue.
Ismail was facing trial in a case for the commission of offence under Foreigners Act and Arms Act before the trial court which has resulted in conviction of the detenue and he was awarded five years simple imprisonment and fine of Rs 10000 by the trial court on April 6 last year with the condition in case fine is not paid by the accused then he shall undergo further six months simple imprisonment.
