HC directs Secy Animal & Sheep Husbandry to produce records

JAMMU, Aug 12: High Court today directed Secretary, Animal/Sheep Husbandry Department to produce the records with regard to the placement of Dr Sunil Kumar Abrol, Incharge Joint Director, ARV R S Pura, Jammu as Director, Animal Husbandry Department, Jammu temporarily in his own pay and grade till further orders.
The court also issued notices to the Secretary, Animal/ Sheep Husbandry Department, Secretary J&K Public Service Commission and Dr Sunil Kumar Abrol Incharge Joint Director/ Director Animal Husbandry Department, Jam-mu.
These directions were passed in a writ petition filed by Dr Ashok Kumar Magotra, Incharge Joint Director Animal Husbandry Department, Jammu challenging the impugned Government Order No.84-ASH of 2016 dated August, 10, 2016 whereby Dr. Sunil Kumar Abrol was asked to look after the post of Director Animal Husbandry Jammu.
When this petition came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Irfaan Mohd. Khan and Suraj Singh appearing for the petitioner drew the attention of the court to the final seniority list of the Veterinary Assistant Surgeons of Animal Husbandry Department wherein the name of the petitioner figures at S.No.7 and on the other hand the name of Dr Sunil Kumar Abrol figures at S.No.13.
“The petitioner is senior to Dr Sunil Kumar Abrol but without any lawful justification the claims of the petitioner were ignored for placement against the higher post of Director, Animal Husbandry Department Jammu”, Advocate Ahmad said, adding “the petitioner is the senior most Incharge Joint Director in the Animal Husbandry Department with unblemished service record of 36 years and his work and conduct has remained satisfactory and the Administrative Department should have respected the seniority of the petitioner while issuing the impugned Govt. Order dated August 10, 2016”.
After considering the submissions of Advocate Ahmed, Justice Dhiraj Singh Thakur looking into the seriousness of the matter directed the Secretary, Animal/Sheep Husbandry Department to produce the records on the next date of hearing.
