HC directs Sr AAG to produce record

JAMMU, Nov 22: In a petition seeking registration of FIR in the ‘recruitment scam’ in the Jammu and Kashmir Legislative Assembly, State High Court today directed Senior Additional Advocate General to produce the record on next date of hearing.
When the petition came up for hearing, Advocate Sheikh Shakeel Ahmad submitted, “though Director of Vigilance has justified the appointments without inviting applications by quoting the Rules 7 and 8 of the Jammu and Kashmir Legislative Assembly Secretariat (Recruitment and Conditions of Service) Rules, 1959 which provide that Speaker is the competent authority for making appointments, but the appointments cannot be made on pick and choose basis without adopting any criteria consistent with Articles 14 and 16 of the Constitution of India”.
“Even the Supreme Court says that employment is a national wealth and every eligible citizen has a right of consideration”, he said, adding “very illogical argument has been taken by the Assembly Secretariat that there is a precedence that Speaker has been making appointments”.
He further submitted that employment is a national wealth and cannot be distributed on pick and choose basis.
In view of non-availability of State Counsel, arguments in the case could not be concluded and Advocate Ahmad strongly prayed for production of record so that High Court can know about the application of mind by SVO while closing the case.
Acceding the submission of Advocate Ahmad, Justice B L Bhat directed Senior Additional Advocate General, Gagan Basotra to make the record available on next date of hearing.
