JAMMU, Dec 23: In the much-publicized case of alleged double drawl of POL (Petrol Oil Lubricants) by the vehicles attached with Deputy Chief Minister and his staff, High Court today directed the State Vigilance Organization to complete the Preliminary Enquiry within a period of six weeks and take a final decision in the matter.
After hearing Advocate Sheikh Shakeel Ahmed appearing for the petitioner Prof SK Bhalla, AAG Ravinder Sharma appearing for SVO, Advocate JP Gandhi for Prabhu Singh, PRO to Deputy Chief Minister and Advocate Adarsh Sharma appearing for P Pole, former VC JDA, Justice Dhiraj Singh Thakur observed, “a status report has been filed by the SSP VOJ with regard to the preliminary enquiry into the allegations leveled in the complaint filed by the complainant-petitioner”.
“From the status report it appears that an enquiry is being conducted in regard to the various vehicles, the registration numbers, whereof are reflected in detail in the status report as also the consumption of POL in connection with these vehicles”, the High Court said, adding “it is stated that there are certain facts with regard to certain vehicles which are required to be verified for which six weeks further time is required for purposes of completing the preliminary enquiry”.
“It can be seen from the record that the complaint had been lodged with the Vigilance Organization by the complainant in September 2012 and the enquiry has yet not been taken to its logical conclusion. It can also be seen from the record that there is enough material already collected by the VOJ which would have been sufficient for it to take a final decision in the matter as to whether a case is required to be registered on the basis of the complaint or not”, Justice Thakur said.
“However, a final opportunity of six weeks is granted to the respondents to take a final decision in the matter on the basis of the facts which are available with the Vigilance Organization or which may be gathered during the further course of verification in the next six weeks”, the Court said.
However, Justice Thakur made it clear that no further opportunity in this regard shall be granted to the respondents.
