HC dismisses PIL as no school occupied by forces

Srinagar, Nov 10:  After Director School Education Kashmir informed that no school has been occupied by security forces, High Court dismissed the petition on occupation of schools by security forces filed by a lawyer and cautioned him for filing such a petition.
The Division Bench of Justice Ramalingam Sudhakar and Justice Ali Mohammad Magrey dismissed the Public Interest Litigation on occupation of schools by security forces with the observation that the petitioner has not undertaken and fulfilled the requirements in terms of PIL rules and has filed it half heartedly and with oblique motive.
“The petition is accordingly dismissed along with the connected MPs. Taking lenient view, we do not impose any costs on the petitioner keeping in view that the petitioner, an advocate, is at the threshold of his career”, reads the Court order.
Court cautioned the advocate and observed that he should remain careful in future and uphold the highest tradition of the legal profession. However with regard to representation made by the petitioner to the concerned authorities on the issue asked the Chief Secretary to consider it and decide the representation in light of norms and rules within a period of two months.
Court said the tool of Public Interest Litigation has been devised to reach injustice wherever it is found overcoming financial, economic, and geographic and locus standi barriers so as to strengthen the hand of social groups. “The petition styled as PIL has been filed without any empirical research and in totally casual manner and the averments made in the instant PIL have no authenticity and are without supportive documentary evidence,” DB said.
