Srinagar, Aug 24: High Court has directed for examination of health condition and medical aid to a Pakistani prisoner involved in transporting drugs from Pakistan Occupied Kashmir and sought opinion from medical board as to whether his ailment is treated inside the jail.
Accused-Musadiq Afzal Masoodi who has been charged for committing offences under NDPS Act in 2017. In the charge sheet filed against him and other co-accused it is alleged that on 21.07.2017 while police was checking the goods being transported from PoK through TFC Salamabad, Uri, they stopped a truck that was being driven by co-accused Syed Yousuf Shah for checking.
During the checking, the police found packets of brown sugar sealed inside 333 cartons and each carton contained packets of brown sugar weighing 50 grams. As per the prosecution case, a total of 66.580 kilograms of brown sugar was recovered from the truck.
The petitioner-accused is stated to be involved in conspiracy of possession and trade of illicit drugs and he is facing trial before the court of 1st Additional Sessions Judge, Srinagar.
Justice Sanjay Dhar after perusal of the medical report of the petitioner-accused said the same reveals that the petitioner-accused is suffering from unstable Angina, Mildly thickened Mycocardium with LV-EDV volume index of 0.1588 with sub aortic LVOT gradient of 13 mm.
It has been reported that his health condition cannot be managed at Government Hospital, Kupwara and that he needs treatment by a specialist at higher centres. It has been further reported by the jail Doctor that he needs to be shifted to some other place where he can be treated and managed by a cardiologist.
Court in view of the medical reports directed the authorities to shift him from District Jail, Kupwara to Central Jail, Srinagar. Court directed the Incharge Central Jail, Srinagar to get the treatment by a Cardiologist from Government Medical College, Srinagar.
The Court directed the Principal, Government Medical College, Srinagar to constitute a Medical Board comprising a Cardiologist as one of its Members for examination of the petitioner so as to assess his health status. “The Medical Board shall furnish its opinion as to whether the petitioner’s ailment can be managed while keeping him inside the jail”, reads the order.
The ground urged in the petition is that he is suffering from serious ailments and as such, he deserves to be enlarged on bail on medical grounds. The petitioner was seeking bail on medical grounds in FIR No. 54/2017 for offence under Section 8/21, 29 of NDPS Act registered with Police Station, Uri.
