Srinagar, Dec 22: The High Court has granted time to authorities to revisit the existing Prison Rules in order to see there is need to any change in light of court directions.
In this connection, District Legal Services Authority (DLSA) is to obtain the copy of draft of the jail manual from Delhi Legal Services Authority to enable the examination of the same in the J&K State as well.
The Division Bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar granted time after the court has been informed that exercise is under way to work on the draft prison manual.
State counsel B A Dar (Sr AAG) sought time to revisit the existing Prison Rules and take a view as to whether the changes need to be effected in the light of the directions passed by this court.
He submitted that the exercise in this regard is under process and one Dr Mehraj-ud-Din, Vice Chancellor, Central University Kashmir, and Dr. V K Kapoor, former Head of the Law Department of Jammu University, are extensively working on the prison manual etc.
“A liberty is given to the Prison authorities and the State Government to take the assistance of these experts given the fact that they have worked on the jail manual earlier”, the DB directed.
Hearing a suomoto cognizance of a letter addressed by Supreme Court for condition of jails and jail inmates, Prison authorities and DLSA are under direction that after obtaining the draft jail manual from Delhi and examine the same in order to apply likewise manual in the J&K State as well.
An exercise with regard to conditions of jails in Delhi has been undertaken under the aegis of the Member Secretary, Delhi Legal Services Authority.
