HC issues arrest warrants against MD TDC

Srinagar, Apr 24: The High Court has issued an arrest warrant against Managing Director Tourism Development Corporation (MD TDC) for defiance of court orders.
Justice Moksha Kazmi has issued bailable warrants of Rs 50000 against MD TDC for securing his presence before court. Justice Kazmi directed the concerned SHO to execute the warrants against the delinquent MD.
On 31st of last month on the request of MD’s counsel, week’s time as final opportunity was granted for filing compliance report of court directions strictly in conformity with the court direction.
Court on that date had clarified that in case order is not complied then Managing Director shall appear before the Court in person.
Today when the matter was called for further proceedings neither any exemption application has been filed nor erring official (MD) chosen to appear before the Court.
Government Advocate appearing for the MD stated that he communicated the earlier order of court to MD.
For not complying the court orders with regard to payment which is due to the petitioner constrained him to file the contempt petition seeking initiation of contempt proceedings for wilful defiance on part of MD.
The stand taken by counsel for MD is that for making payment, codal formalities are to be complied with and it is because of non-compliance of codal formalities that the payment could not be made.
“It is the responsibility of the respondents who have to comply with the codal formalities while making payment and not the petitioner. The petitioner cannot be made to suffer on account of inaction of respondents in fulfilling the codal formalities”, Court said.
The petitioner is a contractor by profession and has executed work for construction of hutments in the year 2018 in famous tourist resort Gulmarg for which the Corporation had paid him half of the amount and for the rest of the payment he was made to suffer on part of the Corporation which compelled him to knock doors of the Court.
