HC issues notice to C/S Health

SRINAGAR, Feb 4: The State High Court today issued notice to Commissioner/Secretary Health and Medical Education Department for violating a court order on filling up the post of Principal Government Medical College (GMC), Srinagar on regular basis.
While hearing contempt petition filed by Dr. Javaid Chowdhry, Justice M H Attar issued a notice to Commissioner/Secretary Health and Medical Education, M K Bhandari, for not implementing the court order on the appointment of Principal Government Medical College (GMC), Srinagar on regular basis.
The court notice reads: “…you will have to show cause as to any contempt proceedings be not initiated against you. Further you are directed to submit the statement of facts/ compliance report”.
Earlier, Court had directed the Government last month to fill up the post of Principal Government Medical College (GMC), Srinagar on regular basis and stayed the temporary appointment of Dr Kaisar Ahmad as GMC Principal beyond four weeks.
Dr. Javaid Chowdhry, who is the senior most in the faculty after Dr. Rafiq Ahmad Pampori resigned from the post of Principal in December last year, had prayed before the court that he should have been considered for the post of Principal GMC, Srinagar.
Aggrieved of the Government order (dated 19.12.2015 whereby Dr. Karisar Ahmad had been given the charge of Principal on temporary basis),  Dr. Chowdhry challenged it before the court on the ground that Dr. Kaisar is junior to him in seniority list of Professors.
Dr. Kaisar has been appointed as Principal of the College on temporary basis (vide Government order No. 814-HME of 2015 dated 19.12.2015) after the resignation by GMC principal, Dr. Rafiq Ahmad Pampori.
According to the testimony of documents placed with the writ petition by Dr. Chowdhry about the seniority position in which petitioner Chowdhry figures at Serial No. 2 while as Dr. Kaisar holds the position at serial No. 3 and at serial No. 1 Dr. Pampori is holding the position, who resigned from the post in December.
