JAMMU, Oct 7: In a petition challenging the reservation rules in promotion to the teachers belonging to reserved category, Justice Dheeraj Singh Thakur today issued notice to Chief Secretary, Director School Education, Commissioner Secretary School Education and other promotees returnable within four weeks.
In the petition, it has been submitted that the official respondents have vide various orders promoted the teachers belonging to reserved categories as Masters by giving them benefit of reservation in promotion, as provided in Chapter-III (Section 6 to 8) of J&K Reservation Act 2004 and the J&K Reservations Rules 2005 particularly Rule 9 and 10.
It was also submitted that 77th Constitutional Amendment Act is not applicable in the J&K and judgment of the Apex Court titled Indira Swahney still holds good within the territories of the State of J&K.
After hearing Advocate Vilakshan Singh appearing for the petitioner, High Court issued notice to State through Chief Secretary and others.
