HC notice on Cong worker’s killing

Srinagar, Dec 19: The High Court today issued notice to Government on recent killing of a Congress worker and sought status report about it by next week.
Hearing a petitioner filed by the wife of the deceased former sarpanch from Dooru area, Justice MH Attar issued notice to Commissioner/Secretary to Home Department, Director General of Police, Inspector General of Police Kashmir range and Senior Superintendent of Police Anantnag for filing objections to the writ petition.
Justice Attar also sought status report from the authorities in this regard and said in view of the urgency into the matter it is listed next week again. Court also issued a notice to State Counsel B A Dar (AAG) in the case.
Wife of the deceased alleged that her husband was killed by the SHO Dooru only to earn name, fame and promotion and she approached the SSP with an application for taking action against the concerned SHO but no action has been taken by the said authority.
It was also submitted that the petitioner has also approached the concerned Judicial Magistrate Dooru in terms of Section 156(30) of CrPC for directing the respondents to register the criminal case against the SHO for the killing of the deceased at the hands of the said SHO but no action despite the order of Judicial Magistrate has been taken by the police authorities.
Petitioner approached the High Court with the prayer that the respondents be directed to register a case of murder and conspiracy against the SHO concerned and investigate the matter by any agency other than Executive.
“The deceased was having no link with any militant organization nor was previously in any act of militancy, nor there was any previous FIR lodged in any Police Station against him with respect to any act of militancy”, read the petition.
Petitioner also submitted that despite granting of bail by the competent court of law, the deceased was not released by the police station Dooru  and was kept in continuous detention and the deceased was murdered by the SHO concerned on 30/11/16 as he (SHO) managed false and fake encounter near village Agnoo Zamaigam of tehsil Dooru, Anantnag.
That there was a great resentment of locals on the killing of the deceased as also protests were held by all the locals of the area who were controlled by the police authorities. Petitioner said the assurance given by the police authorities that fair investigation of the case will be conducted and FIR will be lodged against SHO concerned. The State police agencies have not fulfilled commitment till date despite the petitioner approached the District Police authorities for lodging of FIR against the SHO.
