HC penalises UDD

SRINAGAR, Oct 9: The High Court today imposed penalty on Urban Development Department for not placing before it the details as regards to Model Solid Waste Management (SWM) bylaws of the local authorities.
The Division Bench of Chief Justice Gita Mittal and Justice Puneet Gupta observed that the authorities are not bothered about compliance with the orders of the Court and imposed penalty of Rs 25000 on the UD department for not submitting the details of SWM bylaws of local authorities including all Panchayats, Municipal Corporations, Municipal Councils, Municipal Committees, Development authorities and local authorities in the UTs of J&K and Ladakh on which these bodies have notified the SWM bylaws.
Court said the distressing is the fact that an important issue as notification of SWM of bylaws is not being treated with the seriousness which it deserves and in case after case, the Court is receiving complaints of the lack of any method in the management of SWM in J&K UT.
“In view of the above, we impose costs of Rs 25000 on UDD which shall be deposited with the Advocate Welfare Fund within a period of two weeks from today. Proof of costs deposited shall be placed before the Registry of this court”, the DB ordered.
It sought the details of SWM by laws in tabulation with column giving the date on which the Panchayats, Municipal Councils, Municipal Committees and other local authorities have notified the SWM bye laws.
Court said it is not even being informed in the status of the notification of the SWM bylaws by the local authorities viz panchayats, Municipal Councils, Municipal Committees etc.
Court in so far Sonamarg Development Authority (SDA) is concerned has been informed that SWM bylaws had been adopted and notified by notification dated 21.11.2019 and for effective disposal of the Solid Waste collected at the resort, the authority has installed and commissioned on MT electromagnetic Disintegrator Unit. “The SDA shall also inform this court about its method of collection of solid wastes”, the DB said and directed the authority to file latest status report and action taken report within two weeks before the court.
