HC puts promotions of AEEs’ on hold

SRINAGAR, July 3: The High Court has directed the Government not to act upon on the order whereby various Assistant Executive Engineers were promoted as Executive Engineers.
Challenging the Government order No. 333-PW(R&B) dated 25.5.2018 issued by Commissioner/ Secretary Public Works (R&B) by various AEEs who sought that the order be quashed, Justice M K Hanjura directed the Government not to act upon the order till next date.
“Meanwhile, subject to objections from the other side and till next date of hearing, the impugned Government order 333-PW(R&B) of 2018 dated 25.5.18 shall not be acted upon”, Justice Hanjura said.
The petitioners submitted that an exercise has been undertaken by the respondents for accord of promotion to the post of EEs(Civil) but the respondents are not adhering to the rules.
The  grievance of the petitioners is that the respondents who have already initiated the exercise to accord promotion of the I/C AEEs(Civil) to the post of I/C EE against the post which are lying vacant, are not doing so in accordance with J&K Engineering (Gazetted) service recruitment rules 1978 issued vide SRO 380 and SRO 297.
With this stand before the Court, the petitioners prayed that the order passed by the Commissioner/Secretary is bad in law as such be quashed.
They further prayed that the  officials be commanded  that in case I/C AEEs are to look-after the work of the Division as EEs, in that eventuality the officials should follow the rules of 1978 as also the interim directions already passed by the court earlier.
