SRINAGAR, Oct 28: High Court has quashed the detention of fake faith healer, Gulzar Peer, with the observation that it does not suggest he was being detained in view of indulging in prejudicial activities.
“The order of detention is quashed. The petitioner is directed to be released forthwith if otherwise not detained in any other case”, Division Bench of D S Thakur and Justice Sanjay Kumar Gupta directed.
The petitioner Gulzar Ahmad Bhat alias Peer had challenged his order of detention passed by the District Magistrate, Budgam, Srinagar in terms of Section 8 of the J&K Public Safety Act, 1978 before the Single Bench.
The Single Bench, however, upheld the order of detention and dismissed the petition of Peer constraining him to approach the DB to seek setting aside the order of writ court.
“It becomes clear that the order does not suggest that the petitioner was being detained with a view to prevent him from indulging in activities, which could be prejudicial to the maintenance of public order and that in case, he was not so detained, there was apprehension that the activities in which he was indulging in the past would be repeated by him”, DB said.
DB after perusal of the order passed by the District Magistrate said the same is indeed nothing but a verbatim reproduction of the police dossier prepared by the Senior Superintendent of Police, district Budgam.
