JAMMU, May 8: High Court has quashed the detention order passed by District Magistrate Pulwama against Mohammad Maqbool Wani, son of Ghulam Qadir Wani of Pampore under PSA.
After hearing both the sides, Justice Ali Mohammad Magrey observed, “Detaining Authority’s failure to mention in the detention order about the petitioner’s right to make representation constitutes an infraction of a valuable constitutional right guaranteed under Article 22(5) of the Constitution of India as also of the right under Section 13 of the Jammu and Kashmir PS Act, 1978, which renders the detention order as invalid”.
With these observations, High Court quashed the detention order.
