HC quashes FIR against Surgeon in negligence case

JAMMU, Jan 4: High Court has quashed the FIR against B-Grade Surgeon Dr  Shyam Kumar Gupta in an alleged negligent death case.
After hearing Advocate DS Chouhan appearing for the petitioner, Justice M K Hanjura observed, “pursuant to the complaint before the Director Health Services, an enquiry committee was constituted and the committee examined the case of the deceased in compliance with the mandate of the guidelines laid down by the Supreme Court”.
“The committee, which comprised of three Heads of the Departments of Surgery including the Medical Superintendent, State Veneriologist and Consultant Surgeon, after giving a complete background of the case, opined that the patient was managed as per the standard protocol and no negligence on the part of the treating doctors was found”, High Court further observed.
“Only the experts can delve whether the act attributed to the doctor did or did not constitute gross negligence on his part as such the proceedings initiated against the petitioner on the basis of FIR No. 60/2017 registered against him at Police Station Bakshi Nagar cannot survive”, Justice Hanjura said while quashing the FIR.
