Srinagar, Apr 7: High Court came to rescue of a daily wager by quashing the rejection order of his regularization and directed the authorities to reconsider his case for regularization.
Justice MK Hanjura while quashing the order whereby the representation of petitioner Tariq Ahmad Bhat for regularization of his services was rejected, directed the authorities to reconsider the case of the petitioner for regularization of his services within the parameters set by the court and to pay him all the consequential benefits.
The crux of the case is the petitioner being an unemployed youth , came to be appointed as a casual labourer and worked as such with the respondents.
However, respondents failed to pay him the wages to which he was entitled, which constrained the petitioner to file a suit for mandatory injunction before the Civil Court. This suit culminated into a judgment and decree dated 20th of December, 2002, passed in favour of the petitioner in which the respondents were directed to release and disburse the wages in favour of the petitioner with the further direction to respondents to consider the representation of the petitioner for regularization of his services.
The respondents assailed the order of Trial court in a revision petition before High Court which, by order dated 12th of April, 2011, dismissed the Revision petition.
