Srinagar Aug 11: High Court quashed detention orders of two detenues held under Public Safety Act last year and directed the authorities to release them from the custody.
The Court while hearing the two separate petitions filed by Mubashir Ahmad Rather of Awneera Shopian and Mansoor Ahmad Itoo of Durpora Shopian challenging their detention orders passed against them by District Magistrate Shopian, quashed both detention orders and directed the jail authorities to release both the detenues forthwith from the custody, if they are not required in any other case.
The Court quashed the detention of the duo on the ground that the detaining authority has passed the orders illegally and recorded that these are mere reproduction of the earlier grounds of detention which are supported by the record.
“Therefore, the impugned detention order is vitiated and the same is no more sustainable in the eye of law,” the Court said while quashing detention of Rather.
Court on Itoo’s detention, said: “There is no sufficient compliance with the requirement of law for providing the detenu with the constitutional safeguards, thus, the impugned detention order is illegal and the same is not sustainable”.
