HC raps CB for failing to arrest absconders

SRINAGAR, Mar 20: Board of Professional Entrance Examination (BOPEE) has to again re-draw merit list of Common Entrance Test-2012 (CET-2012) as the candidates studying MBBS course in SKIMS want their inclusion in the re-drawn merit list.
In the redrawn CET-2012 merit list, issued after the cancellation of admission of 21 students who had sought it fraudulently, the BOPEE had not included the candidates who are already pursuing MBBS in Medical College SKIMS and GMC, Jammu so as to avoid discontinuity or disturbances in their course of study.
But the candidates who are studying MBBS in SKIMS have made a representation to BOPEE seeking their inclusion in the re-drawn merit list. The BOPEE is now again re-drawing merit list of the candidates after which the eight candidates who were to be adjusted in GMC Srinagar and Jammu may have to be adjusted in SKIMS.
Some of these candidates who may be adjusted in SKIMS are Manmeet Singh son of Satpal Singh, Puneet Singh son of Joginder Singh, Tapan Sharma son of Bal Krishan Sharma, Gagandeep Singh son of Amrik Singh, Amira Gul Bhat daughter of Ghulam Mohammad Bhat, Jeevita Raina daughter of Sudesh Raina, Munaza Yaqoob daughter of Mohammad Yaqoob Bhat and Tabeer Shoib daughter of Dr Shoib Ahmad Kamil.
In the meantime, the Jammu and Kashmir High Court while hearing a PIL in BOPEE scam today hit out at Crime Branch of Jammu and Kashmir Police for not taking effective steps to arrest 14 absconding beneficiaries  of the BOPEE scam who had sought admission in MBBS course fraudulently.
A Division Bench of the High Court comprising of Chief Justice M M Kumar and Justice Hasnain Masoodi directed the Crime Branch not to wait for court orders for apprehending the 14 absconders. “Don’t wait for court orders for apprehending them, you have the powers. Why don’t you use it”, court observed.
“It is duty of the prosecution to apprise the court in this regard (absconders). They cannot go scot free. They have been declared proclaimed offenders under Section 88. The attachment of their (absconders) property is to be invoked and attachment must follow, attachment is the only method left”, observed court.
The Advocate General of the State, Mohammad Ishaq Qadri submitted before the court that the matter (of absconders) is sub-judice before the trial court. “The trial court has taken cognizance. It has issued warrants against the absconders”, he submitted before the court.
Amicus curie, senior advocate Bashir Ahmad Bashir, during the arguments of the case asked the Crime Branch whether any motion has been laid by the the investigating agency for attachment of the absconders’ properties before the competent court of law. The Crime Branch submitted that they are going to file it soon.
The counsel for the Cellular companies submitted before the court that they have furnished call details to Crime Branch. The Court asked the Investigating Officer of the Crime Branch to go through the call details and if he is not satisfied then he can seek more details.
Court also dismissed the bail application of 15 persons and reserved the orders on bail applications of two women beneficiaries.  While pleading for not granting the bail to 15 persons involved in BOPEE scam, Additional Advocated General, Mushtaq Ahmad Chashoo, submitted before the court that these persons shocked the conscience of public in general and they are prima facie involved in the scam.
