HC rejects accused plea of quashing FIR

Srinagar, Apr 18: While observing that insatiable human greed has caused immense damage to our educational system as such the whole country will become nation of block heads, thus making its future dark, the State High Court today dismissed a petition filed by one of the Elementary Teachers Training College (ETT) owner seeking quashing of FIR filed against him at Crime Branch Jammu in the ETT Scam.
The court while rejecting the plea of the petitioner for quashing the FIR reiterated a saying of a great philosopher who has said that “an education purchased by money is worst than no education at all”.
Court said the enquiry conducted has revealed that the courses conducted by ETT colleges have allegedly turned out to be a huge scandal in the State. “….where money in hundreds of crores has changed hands in the shape of bribe and almost all stake holders are, allegedly involved in the said loot”, said Justice MH Attar while dismissed the petition of one Manish Suri owner of one of the ETT Colleges at Jammu.
The enquiry report, court said, revealed that all sorts of malpractices were committed, in as much, as allegedly, neither registration of candidates was done in time nor classes were started and nor were the hostel facilities provided.
“In the report it was further said that the candidates were lured and amounts, ranging from Rs 45,000 to Rs 80,000 were extracted from each one of them through touts for providing them degrees and certificates by these ETT colleges”, the court said.
Enquiry report further said that these institutions were allowed and permitted to run the courses without issuance of NOC from the State Government, which is granted after inspection of these colleges.
It may be mentioned here that the report also said that a Mafia in league with BOSE authorities is involved in this huge scandal and almost 480 colleges are operating in the entire State out of which 80 are in Kashmir Division and 320 colleges are in Jammu Division and two FIRs have been registered with regard to ETT scam as one in Kashmir and another in Jammu Division.
Court has been informed that in respect of the academic year of 2002-03 report has been filed at Jammu and investigation in respect of other years is continuing and the petitioner Suri is figuring in FIR registered at Jammu along with other accused persons and challan has been filed before the court of competent jurisdiction.
Counsel representing the petitioner Suri submitted before the court that a communication sent by Chairman BOSE to IGP Crime because of the enquiry report of Joint Secretary BOSE and offence u/s 120-B( Criminal Conspiracy) has been added to the FIRs, which according to him would mean that a conspiracy was allegedly hatched by the BOSE authorities with the owners of ETT institutes and FIR registered at Crime Branch Srinagar and the authorities were duty bound to investigate all the allegations, including those made against the petitioner as well and there was no requirement of filing of second FIR in respect of same set of allegations.
On the other hand, State counsel Advocate R A Khan refuted the arguments of petitioner’s counsel with the submissions that reason for filing of two FIRs, one at Srinagar and other at Jammu, is that these ETT colleges are operational in two divisions of the State as such it had become necessary to register to separate FIRs.
Court described the petition as merit-less and dismissed it with the observation: “The insatiable human greed has caused immense damage to our educational system as well” adding: “It is to be imagined as to what will happen to a nation where, without studying, educational degrees would be provided to people. The country will become nation of block heads, thus making its future dark”.
