Srinagar, Oct 27: The State High Court today rejected the plea of Students Welfare Association for deferment of the examinations, scheduled for second week of November, till March next year.
The Court has declined to grant any relief to Petitioner Association and made some observation with regard to deferring of examinations which prompted the Petitioner Association to withdraw the PIL. “After arguing for a while, Petitioner sought withdrawal of Public Interest Litigation. Dismissed as withdrawn”, read the order of Division Bench comprising Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey.
Court during the proceeding of the case observed to advocate Shafkat Nazir representing Petitioner Association that session starts from November to November which means students have studied by approximately 8 months and could have completed more than half of the syllabus. “Why are you hell-bent to loss their one year”, court observed.
Court also questioned about the authentication of the Association and said whether the Association is registered or not to which counsel could not give any reply.
Public Interest Litigation was filed by one J&K Students Welfare Association (JKSWA) for seeking direction for the State Government to defer the examination of Class 10th and Class 12th till March 2017 which are otherwise scheduled to be held from the 2nd week of November.
Direction was sought upon Chief Secretary, Commissioner Secretary Education Department, Director School Education and Secretary Board of School Education.
Association was seeking directions for quashing the date sheets issued by BOSE for class 10th and class 12th. It was pleaded before the court that the respondents be directed to take steps for completing syllabus of different classes including 10th and 12th including practical work of different subjects.
The Association through its president Danish Shafi Bhat in another prayer sought that court direct the authorities to take effective steps for making the situation in Kashmir conducive for conducting board and other exams. It was also stated by the Association that there have been only 84 working days in the academic year 2016 and the students have not completed their syllabus.
It has also been submitted in the petition that the students community has been continuously protesting against the holding of exams in the month of November and in this regard also met the concerned authorities with the requested to defer the examination and create conducive atmosphere for conducting examination.
“The students have not undertaken the normal educational course which is suspended from the last four months and conducting examinations seems to be a political urgency rather than a decision taken on sound reasons,” the petitioner pleaded.
