Srinagar, May 20: High Court today reserved the orders on plea challenging the detention order under Public Safety Act of High Court Bar Association president Mian Abdul Qayoom and directed the authorities to furnish the relevant detention records pertaining to the case.
The Division Bench of Justice Ali Mohammad Magrey and Justice Vinod Chatterji Koul while hearing the appeal whereby Single Bench dismissed Qayoom’s petition and upheld the detention order, sought relevant records from the authorities in order to decide the fate of the appeal filed by Qayoom.
District Magistrate Srinagar has passed the order of detention under No.DMS/PSA/105/2019 dated 7th August 2019 under which Mian Abdul Qayoom has been placed under preventive detention, with a view to preventing him from acting in any manner prejudicial to the maintenance of public order.
Aggrieved of the said order Qayoom challenged the same on various grounds including the grounds of detention are vague, indefinite, uncertain and baseless as also ambiguous and lack in material particulars and essential details, which has rendered detenu unable to make an effective representation against his detention to appropriate authority.
The Division Bench heard both the parties at length and reserved the matter for orders. Court has also directed the authorities to furnish registry of the Court the translation of FIRs which are registered against appellant Qayoom.
