HC restrains JU from declaring Students Union election result

JAMMU, Sept 21: In a petition filed by Yashu Vardhan Singh and others seeking quashment of the guidelines/norms for conduct of elections to Students Union, High Court today restrained University of Jammu from declaring the election result.
In the petition, prayer has been made for quashment of the guidelines on the ground that the same are violative of Lyngdoh Committee recommendations as accepted by Supreme Court of India.
After hearing Advocate Vikram Sharma appearing for the petitioners, Justice Janak Raj Kotwal observed, “the election process relating to Students’ Union of the Jammu University is assailed on the ground that some of the norms/guidelines issued by the University pursuant to 81st University Council Meeting dated 30.10.2016, read with modification order dated 06.09.2016, relating to eligibility and holding of the election are contrary to Lyngdoh Committee’s Report accepted by the Supreme Court vide order dated 22.09.2006”.
“It is apt to first have a detailed reply from the University of Jammu”, Justice Kotwal said. Advocate Anil Sethi appearing for the Jammu University sought short adjournment to file reply.
After hearing both the sides, High Court observed, “as ad interim and till next date only, entire election process shall remain subject to further orders/outcome of petition and final result of the election shall not be declared”.
