JAMMU, May 30: High Court has sought appearance of Director Health Services Jammu and Medical Superintendent Government Hospital Gandhi Nagar Jammu for disobeying the orders.
The notice for appearance was issued to Dr Gurjeet Singh, Director Health Services and Dr Madhuri Salathia, Medical Superintendent Gandhi Nagar Hospital in a contempt petition filed by an employee of the Health Department Jaswinder Singh.
In the contempt petition filed through Advocate Sudershan Sharma, it was submitted that petitioner, a Senior Theatre Technician in Government Hospital Gandhi Nagar was transferred to Government Hospital Sarwal by Director Health Services vide order dated March 13, 2017.
However, when the order was challenged the High Court vide order dated March 16, 2017 directed the respondents that operation of impugned order shall remain stayed till next date of hearing. Though in compliance to the order the respondents allowed the petitioner to continue and also released his salary yet Medical Superintendent Gandhi Nagar Hospital directed the private respondent Pawan Kumar Gupta, Senior Pharmacist in the Hospital to prepare monthly duty roaster of Gynae Operation Theatre. In the duty roaster the name of Jaswinder Singh was deleted.
“This deliberate act on the part of the respondents amounts to contempt of the court as such they are liable for contempt of court proceedings”, Advocate Sundershan Sharma submitted.
After going through the contempt petition and hearing the arguments of Advocate Sundershan Sharma, High Court issued notice for appearance to Director Health Services and Medical Superintendent. They have been directed to appear before High Court in person or duly authorized attorney to answer all material questions relating to the case. They have further been asked to show cause as to why contempt proceedings be not initiated against them.
It was also submitted before the court that private respondent is a Senior Pharmacist whereas the petitioner is a Senior Technician OT and Senior Pharmacist has no role to play in Operation Theatre. In the contempt petition concern has also been expressed over repeated orders of transfers and adjustment of the private respondent and giving charge of Operation Theatre to a Pharmacist against the availability of Senior Theatre Technician.
