HC seeks compliance from CS on green spaces

Srinagar, Sept 14: Observing that there is dismal improvement on green spaces and parks across the State, High Court today directed the matter be put before the Chief Secretary for compliance.
The division bench of Chief Justice Gita Mittal and Justice D S Thakur on a suo moto cognizance taken to a letter addressed by former Chief Justice Bilal Nazki to Chief Justice of the State with regard to encroachments and maintaining of parks in Srinagar city, while observing that despite the directions passed on December 28 last year did not yield fruitful results as such the matter be placed before the CS for compliance.
Court after perusal of status report filed by Director Floriculture said, nothing worth and fruitful is coming on the record about improvement of green spaces despite draft action plan for augmentation of green spaces in Srinagar city stands formulated by the CTP even there is no park in Jammu.
Court added that it appears the draft action plan have to be implemented through the Housing Urban Development Corporation as also the CTP was directed to submit report on sufficiency of green spaces in Srinagar.
Keeping in view that the draft action plan was required input from other sources and the court had directed for preparation of SOP so that for all seasons, in Srinagar and Jammu can be made environmentally vibrant.
Ii is pursuant to the direction of December 28, vide Govt order no. 267-GAD Dated 27.2.18 the committee has been constituted. Status report of Director Floriculture indicating therein setting up of 11 parks and funds Rs. 64.17 lakhs released in favour of Executive Engineer floriculture for further green spaces and parks.
Court directed the amicus curie to visit all these 11 parks within one week from today and submit report with photos about the status of these parks. Court directed the registry to furnish the copy of the letter of former chief justice, copy order dated 28.12.18 and the instant order to CS for compliance.
Former Chief Justice Bilal Nazki in his letter suggests for Identifying areas/locations in Srinagar completely lacking parks/green spaces and Identifying and earmarking an area in each locality of Srinagar for development of a park/green space/ urban forest and set a time line within which such work is undertaken and completed by authorities.
Court in its note has said that the issues raised by former chief justice in his letter are very important to each and every resident of the cities of Srinagar and Jammu. The State Government, it appears has ignored the pertinent issues raised by a dignitary of former Justice, which is clear from the facts that the government has not even care to respond to the communication of the High Court.
