HC seeks compliance for refund of deposited amount

Srinagar, Apr 13: High Court today issued notice and sought compliance of court orders for release and refund of amount deposited in lieu of allotment of land on lease to National Conference Provincial Secretary of North Kashmir’s Baramulla district within six weeks with interest.
The compliance of court direction has been sought in a contempt petition filed by advocate Mir Suhail on behalf of the National Conference (NC) Provincial Secretary Showkat Ahmad Mir seeking compliance of direction whereby authorities were directed to refund the amount of Rs. 16.66 lakh with interest as the land in question has not been handed over to the party despite fulfillment of all requisites.
Justice Sanjay Dhar after having gone through the court direction, issued notice and sought compliance from Commissioner Secretary Revenue, Divisional Commissioner Kashmir, Financial Commissioner and Deputy Commissioner Baramulla.
Court had directed the concerned authority to immediately and forthwith release the amount of Rs. 16,66,668 in favour of the petitioner-party preferably within a period of six weeks from the date a copy of this order is served upon them. “The petitioner is also entitled to interest at the bank rate which is paid for the money deposited in the saving account”, Court had further added.
On failure of implementing these directions petitioner has been compelled to file contempt petition against these officials. The petitioner-party had applied for and required land measuring 01 kanal 13 marals for constructing their party office and therefore the land offered to it was less by 19 marals which was not found suitable for office.
