HC seeks compliance from Director S&WC in contempt case

SRINAGAR, Aug 13: High Court has sought compliance of the court order from the Director of the Soil and Water Conservation for considering the promotion of the petitioner against higher post.
Petitioner-Manzoor Ahmad Kangan has filed the contempt petition alleging violation of order passed by the Court on 31.05.2013 in which Court had directed the respondents to consider the case of the petitioner-Kangan for promotion against higher post keeping in view of his stagnation on the post of Deputy Forester since 30.12.1997, in accordance with the rules governing the subject.
On notice Principal Chief Conservator of Forest and HoFF Jammu and Kashmir has filed statement of facts, wherein it is stated that the IWPD (Hill) project was time bound and was closed by the Government of J&K in February 2019 and employees borne on IWDP (Hill) were deputed along with post to the various wings of Forest Department.
He further stated that the petitioner has been deputed to the Department of Soil and Water Conservation for further duties and after issuance of SRO 719 dated 25.10.2019 any preferential claim whatsoever, has to be looked after by the respective HOD.
Justice Ali Mohammad Magrey, keeping in view the stand taken by Principal Chief Conservator of Forest, said the order is required to be implemented by the Director of the Soil and Water Conservation, therefore sought his compliance.
Court directed the counsel appearing for the Forest Department to send a copy of this order along with a statement of facts filed by Principal Chief Conservator of Forest and HoFF Jammu and Kashmir, to Director, Soil and Water Conservation, for seeking his compliance.
Dealing with another contempt petition, the court directed the Director J&K Horticulture Planning & Marketing to release the balance amount for execution of work in favour of the petitioner within two weeks or appeal in person on next date of hearing before the court.
The direction followed after the court was informed by Advocate Shakir Haqani that the execution of the work by the Petitioner through nodal agency has been admitted, which work stands already handed over to the intending Department.
He further submitted that, now, it is the intending Department which has to release the balance amount of Rs. 15,14,698 in favour of the Petitioner and that despite repeated reminders, the needful is not being done by the intending Department.
