Srinagar, Oct 25: The High Court today sought the details of cases and orders passed by the Supreme Court regarding the plea seeking safeguards of State subject till outcome of petitions challenging the scrapping of Articles 370 and 35A before the Supreme Court.
The petition has been filed by one Rekha Qazi Wangnoo, a migrant seeking orders from the Court that the authorities be directed to safeguard the State subjects against any Socio-political invasions or dilution or tampering of with Kashmiri civilization.
She sought that the authorities be directed not to sale, purchase, transfer or lease of land to non state subjects ,till disposal of pending petitions with regard to the issue before the Supreme Court of India.
“In this background, let the respondents ascertain and inform this court about the details of the cases, the issues raised and the orders passed by the Supreme Court of India before the next date of hearing”, Division Bench of Chief Justice Gita Mittal and Justice Rajesh Bindal said before issuing notice to Government of India and State Government.
She pleaded that wherein the same Constitution of India has granted special Rights to Nagaland in matter relating to religious or social practices of indigenous population, their customary law and procedure, administration of civil or criminal justice involving decisions according to their customary law and ownership and transfer of land and its resources under Article 371-A and thus cannot be denied to the domiciles of Jammu & Kashmir by way of violation of the same rights as granted under the same Constitution.
She as such prayed that the orders by the court be passed directing the authorities for protection of rights of State subjects on Land, immovable property, employment and safeguards for Kashmiri cultural identity and religious places .
