Srinagar, May 29: High Court today asked the Government to come up with a formal application seeking raising of any construction for ensuing Amarnath Yatra in Sonamarg.
These observations were made by the Division Bench of Chief Justice N Kotiswar Singh and Justice Moksha Kazmi to the submissions made by the Government counsel before the bench.
As soon as the matter was taken, the counsel representing authorities prayed for modification of order passed by the coordinate bench on March 27 imposing complete ban of any kind of construction in and around the resort.
The counsel referred that the authorities are required to raise certain kind of constructions for the Yatris and the deputed staff as such the main order may be modified to some extent.
To these submissions court asked the counsel to make a detailed application for the purpose indicating there the details of constructions minutely.
Court also asked all the parties for suggesting name of experts as earlier discussed so that a panel is constituted to find out the veracity of blue print prepared by the SDA.
Bench was hearing an application filed by the Sonmarg Development Authority (SDA) seeking lifting of partial ban on construction in and around the resort so that developmental works for Yatra are carried ahead in and around the resort.
It is noted that the court has already been informed that the recent committee formed under the chairmanship of Deputy Commissioner Ganderbal is in total contravention of earlier minutes of meeting held by the SDA whereby it was decided that no construction shall be carried out or be allowed till the new Master Plan for the resort is finalized.
“Without placing on record the important material, CEO SDA has moved application for modification of ban order in a deceitful and cunning manner under the pretext of Tourism department and Baltal Yatra. Under the guise of upcoming Yatra, the said blueprint has been prepared by the SDA in derogation of the environmental hazards”, reads the application in opposition to the application filed by SDA for modification of ban order.
