SRINAGAR, Apr 5: High Court today directed the State Government to inform the court about the implementation of Solid Waste Management Rules of 2016 on ground as also the steps taken for notifying the Solid Waste Management bylaws.
The Division Bench of Justice Ali Mohammad Magrey and Justice Tashi Rabstan while hearing Public Interest Litigation on protection of environs of Sonmarg tourist resort directed the Principal Secretary Housing and Urban Development Department to file an affidavit indicating therein as to what steps have been taken for implementation of action plan of SWM bylaws.
The DB also directed him to file an affidavit indicating therein the implementation of SWM Rules of 2016 on ground level. The direction came after the amicus to the PIL advocate Nadeem Qadri pointed out that the rules are already existing and the authorities be asked as to what steps they have taken to implement the same.
State counsel B A Dar (Sr. AAG) informed the court that as per the previous directions of the court, the SWM bylaws have been notified as also the action plan of those bylaws is ready but those could not be filed on time as the authorities were engaged with upcoming Parliamentary elections.
Court granted advocate Dar further two weeks time to place the notified SWM bylaws and action plan thereon before the court on next date of hearing.
Principal Secretary H&UDD also moved an application for exemption of his personal appearance before the court which was accepted.
Court has been further informed that the CEO SDA has been transferred and the charge has been handed over to Deputy Commissioner as such the compliance report about the Comprehensive Environment Impact Assessment (EIA) so that the MP for Sonmarg is finalized. With these submissions court in the interest of justice granted more time for compliance of court directions.
