HC seeks personal appearance of officers for withholding medical claim

Srinagar, Jan 12: High Court has taken serious note of not releasing the medical claims of the petitioner for treatment of her mother suffering with carcinoma and directed personal appearance of concerned officials of Accounts and Treasuries.
Justice Rahul Bharti while taking serious note of the act of the officials of Accounts and Treasuries directed the Registrar Judicial of the court to issue notice of personal appearance of Director Accounts and Treasuries Kashmir and others.
“The SSP, Anantnag is directed to apprise the Director Accounts and Treasuries, Kashmir, at Srinagar, District Treasury Officer, Anantnag and Treasury Officer, Kokernag with respect to their personal appearance in the Court on Tuesday i.e., 16.01.2024”, Justice Bharti directed.
This petition by the petitioner-Dr. Rifat Majid Mir is literally a distress call to this Court invoking Article 226 of the Constitution of India with the grievance that for her ailing mother who is suffering from a cancer under treatment is on the verge of suffering loss of life because of acts of omission or commission on the part of these officials with regard to matter of reimbursing of her medical claims in connection with the treatment of her mother.
Her counsel stated at the bar before the court that the Ajaz Hussain Padder, who is a Treasury Officer, Kokernag, with whom her reimbursement bills are pending approval has put a phone call to the mobile number of the counsel for the petitioner-Mir with the words that unless and until she withdraws the writ petition, he is not going to process the reimbursement file.
“The matter is too serious to be taken casually or leniently, as such, this Court directs issuance of notice to the respondents”, Court said and accordingly before proceeding ahead against these officials sought their personal before the court.
