Srinagar, Nov 30: The High Court has warned for personal appearance of Secretary Finance in case Goods and Sales Tax (GST) Tribunal is not constituted.

The Division Bench of Chief Justice Tashi Rabstan and Justice Puneet Gupta has granted the final opportunity of complying with its previous direction with regard to the constitution of the GST Tribunal.
In its previous direction, the court had sought information with regard to the constitution of the General Sales Tax (GST) Tribunal and process of selection of staff of the said tribunal by next date of hearing.
The Government counsel today sought some more time to do the needful in terms of the previous order.
The bench at his request granted last and final opportunity of four weeks to him to comply with the orders of court with the condition that in case orders are not complied with then Secretary to Government of J&K, Finance Department, shall remain present on the next date of hearing
The court previously was informed that the committee has already initiated the process of selection of the Technical Member and has sought some time with regard to the constitution of the GST Tribunal.
The court has also asked the research committee to expedite the process so that the appointment of the Technical Member be made at the earliest.
The court has arrayed the Government of India through its Secretary, Ministry of Finance as respondent in the suo moto proceedings by recording that considering the fact that the presence and consent of the said officer will be necessary for constituting the GST Appellate Tribunal.
Advocate Tahir Shamsi, Deputy Solicitor General of India has already entered his appearance on behalf of Secretary Finance.
