Srinagar, Apr 18: Jammu and Kashmir High Court today sought presence of Chief Secretary of the State before the court on next date for failing to file a compliance report in acid attack case.
The Chief Secretary’s presence has been sought after he failed to file compliance report to HC directions seeking enforcement of laws laid down by the Supreme Court in connection with the acid attack case and enactment of appropriate provisions for effective regulation of sale of acid in the State.
Court sought personal appearance of CS as the respondents are not complying the court directions in letter and spirit as they were directed to inform the court about the amount received by the Hospital authorities on treatment of acid attack victim.
“It appears that respondents have not exhibited the required urgency in seeking the information from the authorities of the Apollo Hospital, Chennai, about the amount received by them in the second phase of treatment of the victim of acid attack”, observed the Division Bench of Justice MH Attar and Justice B S Walia.
Court pulled up the State counsel R A Khan (AAG) in this regard and expressed anguish over the act of respondents and flouting the court orders as such directed the CS, if compliance of the court directions is not filed then he shall appear personally before the court.
“In the facts and circumstances of this case, we extend time by two weeks for compliance of the aforesaid court orders, failing which respondent No. 1 appear in person on the next date”, court directed to CS.
Court after repeated requests from advocate Khan granted two weeks’ time to him for filing compliance by the authorities in respect of earlier directions passed by the court.
In the instant PIL petitioner is seeking enforcement of laws laid down by the Supreme Court in connection with the acid attack case and enactment of appropriate provisions for effective regulation of sale of acid in the State.
The instant PIL was filed after some unidentified car borne youth on December 11 threw acid at a law student at Nowshehra, Srinagar inflicting serious burn injuries on her face and damaging her right eye and court had directed the State Government to bear the expenses required for the treatment of the victim.
