SRINAGAR, Apr 18: Justice Hasnain Masoodi today directed Director Horticulture Department to remain present before the court and explain the delay and disobedience of court order unless compliance by next date.
Court sought personal appearance of the official in a contempt petition seeking enforcement of court order passed on August last year wherein court had stayed two communications in which department had initiated process for determination of age of employees.
Petitioner Abdul Ahad Tantrey, who is the employee of the department claims to have been appointed as Gardner in the year 1980 and his date of birth has been recorded as 17.6.1960 in his service book as per the school leaving certificate.
Department vide two communications had initiated the determination of the age of various employees including petitioner and petitioner was found to be 60 years of age as on May 6th 2014 by the Medical Board.
Challenging the determination of age, petitioner Tantrey through his advocate S R Hussain highlighted that the process is totally contrary to the settled service rules and article 35AA of CSR and on the submissions court stayed both the communications to the extent of petitioner.
