HC seeks progress on constitution of Commission for Protection of Child Rights

Srinagar, Aug 10: High Court has directed the Government to apprise it about the progress of constitution of Jammu and Kashmir Commission for Protection of Child Rights in the UT.
The direction has been passed by the Division Bench of Chief Justice N Kotiswar Singh and Justice M A Chowdhary after the bench has been informed that the Social Welfare Department has constituted a five member committee to recommend for appointment to the post of Chairperson and members, J&K Commission for protection of the child rights.
Court has been informed that the rules have been framed which were notified on 21.10.2022 under SO No. 542 namely “The Jammu and Kashmir Commission for Protection of Child Rights Rules, 2022. “Under the circumstances, counsel for the respondent administration, will apprise this court as to the progress of the constitution of J&K Commission for Protection of Child Rights”, DB directed.
The bench was hearing Public Interest Litigation, highlighting the violation and infringement of rights of minor children and other vulnerable groups with respect to the implementation of the Protection of Children against Sexual Offences Act, 2012 (POCSO) and other relevant laws made for the protection of children and prevention of crimes against them.
A detailed report with respect to the pendency of cases related to child sexual abuse in the Union Territories of Jammu and Kashmir and Ladakh is also being sought from the authorities and fast-track all the child sexual abuse cases in the Union territories of Jammu and Kashmir and Ladakh and ensuring that the serial offenders of systemic child abuse who pose serious threat to the safety and security of children are commissioned to custody and punished.
