HC seeks reply on formation of GST Tribunal

Srinagar, Dec 26: The High Court has sought reply from the Ministry of Finance with regard to establishing the GST Appellate Tribunal in Jammu and Kashmir.
The Division Bench of Chief Justice N Kotiswar Singh and Justice M.A. Chowdhary has sought reply from the Ministry of Finance in suo moto proceedings after arraying it as party respondent to the PIL by observing that the presence and consent of the Secretary, Ministry of Finance will be necessary for constituting the GST Appellate Tribunal.”
Deputy Solicitor General of India has entered his appearance and accepted notice on behalf of the Secretary Ministry of Finance. Court directed him to file his response by the next date of hearing.
The PIL was registered earlier this year after considering that the GST Appellate tribunal is not in place in J&K and the litigants are facing considerable hardships. Given the complexity of the issue, the court appointed senior advocate R A Jan as amicus curiae.
It is mentioned that the Rajya Sabha last week granted an approval to a bill aimed at facilitating the setting up of Goods and Services Tax (GST) Appellate Tribunals (GSTAT).
The bill provides crucial modifications to the terms of appointment for Tribunal members and establishes a minimum age of 50 years for both members and presidents of the Tribunal by introducing a provision allowing advocates with a minimum of 10 years of experience, particularly in matters relating to the field.
