Srinagar, Apr 24: High Court today directed the Public Works Department to inform the court with reference to the release of funds for completion of road widening from Dalgate to Hazratbal Srinagar.
The Division Bench of Justice Ali Mohammad Magrey and Justice Tashi Rabstan directed the Principal Secretary PWD to file the response about the release of funds for completion of the project.
The direction followed after court found in the status report of CE PWD that due to non-availability of the sufficient funds, the project is yet to be completed and the matter has taken up with the Administrative Department for release of funds.
Chief Engineer, PWD (R&B), Kashmir in his affidavit also indicated the steps taken for ensuring disposal of the cases, pending before the various courts with reference to subject of the completion of ongoing road widening from Dalgate to Hazratbal.
Counsel representing PWD was asked about the latest position of the cases. He submitted that these cases are still pending decision before the Principal District Judge, Srinagar, Sub Judge/Small Causes Court, Srinagar and this court.
“He shall furnish the list of the writ petitions to the Registrar Judicial of this court during the course of week and on receipt Registrar Judicial shall list all those cases before the roster Bench on 21.05.2019″, DB directed.
Court directed the department through its counsel to ensure completion of the pleadings viz, filing of reply, before the Registry, Principal District Judge, Srinagar, and shall ensure expeditious decision of the matters having reference to widening of the road from Dalgate to Hazratbal pending before its Court and other Courts of the district and CE PWD has been directed to provide the details of these case to him during the course of the week.
The instant Public Interest Litigation relates to the ongoing road widening programme in the city of Srinagar from Dalgat to Hazratbal, which commenced way back in the year 2009-10.
