Srinagar, Mar 5: High Court has directed the Government to inform it about the measures taken with regard to reservations in job and public employment for transgenders in both UTs of J&K and Ladakh as also their admission in colleges and schools as third gender.
Court issued notice to Chief Secretary of the Union Territory of Ladakh for filing of status report informing therein as to what steps have been taken for reservation of jobs for the transgenders. The same direction has been passed to the Government of J&K UT.
“Let a copy of the order dated 20th March, 2019 and the last three orders be sent to the Chief Secretary, Union Territory of Ladakh”, DB directed.
Counsel representing Social Welfare Department Sheikh Feroz Deputy AG, sought time to file a status report on behalf of the department in terms of previous order. Court directed him to inform in the status report regarding the measures taken with regard to the reservations in job/public employment for transgenders.
Court has also granted time to Government to place a status report on record regarding the steps taken by the Higher Education Department in compliance with the directions of the Supreme Court.
A status report has been filed by the School Education Department, placing on record the communication addressed by the Additional Secretary to Government, School Education Department to the Director, School Education, Kashmir/Jammu, to make provisions in the Admission Form about the admission of transgenders as third gender. “The same communication requires a direction to the School Education Department to issue directions to all the Schools of the Union Territory of Jammu and Kashmir in this regard”, Court directed.
Court has sought a compliance report of the directions made in the communication of Directors of School Education Department of Kashmir and Jammu before the next date of hearing. “The Director, Education Department of Kashmir as also Jammu shall also obtain compliance reports from some of the schools and place the same before us before the next date of hearing”, reads the order.
Court given the several steps which are being taken in the Union Territory of Jammu and Kashmir for compliance of the directions of the Supreme Court in National Legal Services Authority Vs Union of India and others asked the petitioner to make an enquiry among the transgenders and report the court with regard to the utilization of several benefits and schemes, if any, of the Central Government and the other Union Territories, specially the measures taken to enable the transgenders to secure admissions in the institutions of education.
