HC seeks response from Govt on private tuition ban

SRINAGAR, Aug 25: High Court while granting last and final opportunity of filing objections to the plea of teachers challenging the circular directing them not to give private tuition to the students, said in case objections are not filed then court will proceed in the matter on next date of hearing.
Justice Ali Mohammad Magrey after hearing the counsel Sheikh Umar Farooq on behalf of the petitioner-teachers granted weeks time of last and final opportunity to the authorities to file the objections in the plea and in failure of same the court shall proceed in the matter on next date.
In the instant petition, the petitioners have assailed the validity of Circular bearing No. CEO/A/IMW/32359-550/21 dated 12th of January, 2021 issued by the Chief Education Officer Anantnag, in terms whereof the Teachers/ Lecturers have been directed to desist from giving tuitions to the students.
Advocate Umar submitted that on February 11 while issuing notice, the Court had directed the respondents to file objections. “Thereafter, further time was extended to the respondents for filing the objections, however, needful not done, till date”.
When asked to counsel appearing for the Education Department, he sought one last opportunity for filing the Objections. “Accordingly, the last opportunity of one week is granted to the respondents for filing the Objections, failing which appropriate orders shall follow on the next date of hearing and the Court will be constrained to decide the matter in absence of the Objections of the Respondents”, Justice Magrey directed.
