Srinagar, Apr 22: High Court today sought response from Telecommunication authorities to the plea seeking removal of installation of mobile tower which has been installed in close proximity of public health center in Kargil.
The Division Bench of Justice Ali Mohammad Magrey and Justice Tashi Rabstan in this connection sought response from Secretary telecommunication New Delhi, Chief General Manager Bharan Sanchar Nigam Limited Jammu, telecommunication district manager Leh, Chief Executive Officer LAHDC Kargil, Chief Medical Officer Kargil others by or before May 15.
Petitioner counsel pleaded before the court that the erection of tower in the close proximity of hospital is not only in violation of rules and regulations governing the field but also at the same time causing grave injury to the health of the patients who are admitted in the hospital.
He submitted before the court that till the response is filed, the authorities may be directed to relocate the said tower to some other place, which the court declined with the observation that after the filing of response the said request may be considered.
The removal of the tower is being sought over the possible hazardous health effects viz, cancer and other diseases by the emission of harmful radiations from the said tower. “The action of the respondents is illegal and is adversely affecting the health of the locals who are not in a position to protect their own interest on account of poverty, incapacity and ignorance”, reads the PIL.
Direction is being sought particularly on Secretary Telecommunication New Delhi, Chief General Manager Bharan Sanchar Nigam Limited Jammu, telecommunication district manager Leh to remove the mobile tower which has been installed in close proximity of New Type of Public Health Centre Batalik Kargil and reinstalling the same as per the norms and guidelines.
It is further submitted that CMO Kargil and Bharti Airtel Limited be restrained from installing the tower in close proximity of the health center situated at Batalik Kargil.
