HC seeks response to appeal of PDP leader Parra

Srinagar, Sept 29: High Court today sought objections from the prosecution to the belated appeal filed by the Peoples Democratic Party youth president Wahid-ur-Rehman Parra against the rejection of his bail by the Special Judge designated under NIA Act.
Parra has approached the Division bench of the High Court against the rejection of his bail by NIA designated court on July 20 to which the Division Bench has said the appeal is 33 days of delayed to approach the court by the appellant-Parra.
The DB comprising Chief Justice Pankaj Mithal and Justice Vinod Chatterji Koul issued notice to Investigating Officer of Police Station Counter Intelligence for filing of objections to the delay application filed by Parra.
Court, however, directed the registry to serve the notice to Government counsel B A Dar (Sr. AAG) and directed him to seek instruction and file reply to the condonation delay application within a month.
Parra in his appeal submits that the rejection of bail to him by the trial court is vitiated in law having been rendered against the mandate of law regulating and governing grant of bails in such cases.
He seeks that the impugned judgment of NIA Court rejecting his bail application be set aside and he be admitted to bail on the terms and condition as put by the court.
Petitioner Parra has already challenged the FIR No. 31/2020 registered against him under Section 13, 17, 18, 39, 40 of Unlawful Activities Act read with Section 120-B, 121, 121-A, and 124-A of Indian Penal Code.
The belated appeal reveals that the investigation under the FIR was taken over by the National Investigating Agency and the petitioner was arrested in the case on November 2020. Parra as per his pleadings before the court was admitted to bail by the Sessions Court Jammu in January 2021 and immediately after his bail was arrested in the FIR in question again.
The FIR 31/2020 reveals that some political functionaries are misusing their membership of position in and or have affiliation with political parties as part of a criminal conspiracy, established clandestine connections and relations with different Pakistani supported terrorist and secessionist organizations operating in J&K
