HC stays ACB FIR against builder

JAMMU, Mar 3: High Court has stayed the FIR against against Shahid Buch, who has been booked by the Anti-Corruption Bureau for constructing commercial flats without seeking mandatory permission from JDA and in complete violation to the then building by-laws.
After hearing Advocates DK Khajuria and Rajesh Gupta for the petitioner, Justice Sanjay Dhar observed, “subject to objections and till next date before the bench, proceedings in the impugned FIR to the extent of the petitioner shall remain stayed”.
High Court also issued notice to the respondent, which was accepted by AAG Raman Sharma. He has been directed to file his response by or before the next date of hearing.
The petitioner has challenged FIR No.1/2022 for offences under Section 5(1)(d) read with 5(2) of the Prevention of Corruption Act and Section 120-B of RPC registered with Anti Corruption Bureau, Jammu.
