JAMMU, June 25: High Court has stayed the appointment of Dr Rakesh Kumar, Assistant Director, Indian Systems of Medicine, as Registrar J&K Board of Ayurvedic and Unani Medicine.
The stay was granted in a petition filed by Dr Chatru Ram M Munday, challenging the appointment of Dr Rakesh Kumar.
According to the petitioner, the post of Registrar was advertised Vide Notification No ISM./Pr./Board/J&K 309 dated 03.02.2014 and pursuant thereto, the President, Board of Ayd/Unani Systems of Medicine issued appointment order of the petitioner dated 20.05.2014 subject to the approval of the Administrative Department.
“The Administrative Department deliberately delayed the approval to appointment of the petitioner and later appointed private respondent temporarily to further delay the petitioner’s appointment”, Senior Advocate M K Bhardwaj said, adding “Dr Rakesh Kumar never participated in the selection process and without doing so he has been appointed as Registrar”.
After hearing Senior Advocate MK Bhardwaj assisted by Advocate Aditya Sharma appearing for the petitioner, Justice Janak Raj Kotwal issued notice to Commissioner Secretary Health and Medical Education Department, J&K Board of Ayurvedic & Unani Medicine through its President, Director ISM Srinagar, Deputy Secretary Health and Medical Education Department and Dr Rakesh Kumar returnable within four weeks.
In the meanwhile subject to objections and till next date before the bench, High Court stayed the impugned order dated 15.05.2014.
