HC stays DC Kathua’s notice to R B Trust

JAMMU, Mar 13: In a petition filed by R B Educational Trust, Kathua through its Trustee Kanta Andotra, wife of Congress MP Ch Lal Singh, State High Court today stayed the notice issued by the Deputy Commissioner Kathua on March 5, 2013 under the Agrarian Reforms Act.
After hearing Senior Advocate Sunil Sethi with Advocate Advocate Veenu Gupta for the petitioner, Justice Muzaffar Hussain Attar issued notice to the State through Secretary Revenue, Deputy Commissioner Kathua and Tehsildar Hiranagar returnable within four weeks. In the meanwhile, the High Court stayed the order of Deputy Commissioner Kathua.
In the petition, it has been submitted that Trust is holding 40 kanal Gair Mumkin land, 122 kanal Banjar Kadim, 70 kanal irrigated land in the shape of orchard and 80 kanal of Nehari land.
“The Public Interest Litigation before the High Court is pertaining to some other persons and in that PIL, a CMA has been filed against the husband (Ch Lal Singh) of the Trustee, who is Member Parliament alleging that he has encroached 92 kanal and 6 marlas of State land”, the Writ Petition said, adding “application/CMA has been filed on the basis of some report of the Vigilance Organization sent to the Government in the year 2006 and the Government has not taken any decision thereupon”.
In the petition, it has been further submitted that land under reference was not in possession of husband of the Trustee and his name had been wrongly dragged into the controversy.
“The order passed by the Deputy Commissioner Kathua directing the petitioner to elect the land as per the scale of Agrarian Reform Act is totally illegal and contrary to the provisions of the Agrarian Reform Act”, the petitioner submitted.
