JAMMU, May 24: High Court today stayed the examination of Assistant Legal Remembrancer and Public Law Officers (PLOs).
While issuing the order staying the operation of the impugned notice dated 10th of April, 2018, Justice Ali Mohammad Magrey observed, “on the requisition of the intending department(s), various posts of District Litigation Officers and Assistant Legal Rememb-rancer/ Public Law Officers have been advertised by the J&K Public Service Commission vide advertisement notification Nos. 20-PSC (DR-P) of 2016 dated 29th of December, 2016 and 03-PSC (DR-P) of 2018 dated 29th of January, 2018”.
“The petitioners are aggrieved of notice issued by the respondent-Public Service Commission under endorsement No. PSC/Exam/ WT/DLO.ALR/ PLO/2018 dated 10lh of April, 2018, whereby the date for holding of the common examination for the posts of District Litigation Officer and Assistant Legal Remembrancer/ Public Law Officer has been notified”, High Court said.
“The petitioners have also called in question Paragraph No.3 of the Notification No. 20-PSC (DR-P) of 2016 dated 29th of December 2016, in so far as it provides for the method of selection to be governed by Rule 51 of the Rules of 1980 as also Clause 3 of the Notification No. 03-PSC (DR-P) of 2018 dated 29th of January, 2018”, the High Court further said.
“Advocate Hilal Akbar Lone appearing for the petitioners submits that the impugned notice dated 10th of April, 2018, whereby a common examination has been notified for two different posts advertised vide two different notifications has jeopardized the rights of the petitioners as have accrued to the petitioners upon their applying separately for both the notifications”, the High Court observed.
Accordingly, Justice Magrey issued notice to J&K PSC returnable within four weeks and ordered that in the meantime, subject to objections from the other side and till the next date of hearing before the Bench, the operation of the impugned notice dated 10th of April, 2018, shall remain stayed.
