HC stays fee fixation of schools

Srinagar, Oct 14: The State High Court today directed the Chief Secretary and Chairman Committee for Fixation of Fee, Justice (retired) Bilal Nazki, to maintain status quo till next hearing on fixing fee structure in private schools in the State.
Hearing a writ petition filed by J&K Unaided Private School Coordination Committee, a Single Bench of High Court Justice Hasnain Masoodi also directed the respondents to file objections, if any, within three weeks.
The petitioners are seeking quashing of Government order number 520-13 dated: 7-05-13 which ordered constituting a committee for fixing fee structure in private schools which is headed by retired Justice Bilal Nazki and stay on the functioning of Nazki committee during the pendency of writ petition.
Counsel for UPSCC, Advocate Rifat Ara, pleaded before the bench that the Government has constituted the committee in violation of Education Act 2002 and Education Rules 2010.
Pointing out a Supreme Court judgment (Islamic Academy versus State of Karnataka), Ara pleaded that the Apex Court had never directed for constituting committee for fixation of fee in Elementary and School Education Sector, adding, the petitioners have reliably learnt the Chairman CFF Justice Bilal Nazki is proceeding to fix the school fee without any authority in Law, misreading the judgment of the Apex Court.
