HC stays Govt order on relaxation of rules

JAMMU, Dec 1: In a petition filed by degree holder engineers of the Power Development Department, High Court has stayed the Government order regarding relaxation in rules for promotion of diploma holder engineers as Executive Engineers/Assistant Executive Engineers on stop-gap arrangements.
The petitioners namely Neeraj Sharma, Ravinder Kumar Malla, Subash Chander Gupta, Rajinder Kumar Gupta and Anil Gupta while challenging the Order No.PW/R&D/ADM/22/2011 dated 17.7.2012 submitted that relaxation of recruitment rules would result into total chaos.
Senior Advocate P N Raina with Advocate J A Hamal appearing for the petitioners drew the attention of the High Court towards Apex Court judgment in Suraj Parkash Gupta Versus State of J&K and said, “relaxation of recruitment rules cannot be allowed in view of the Supreme Court judgment”.
On this, Justice Tashi Rabstan issued notices to Chief Secretary, Commissioner Secretary PDD and Commissioner Secretary PWD returnable within two weeks.
In the meanwhile, subject to objections from other side and till next date before the bench, Justice Rabstan stayed the impugned order. “The respondents are at liberty to consider the claim of the petitioners for promotion to the post of Executive Engineers strictly in terms of the Recruitment Rules occupying the field”, Justice Rabstan said.
