JAMMU, Sept 16: High Court of Jammu & Kashmir and Ladakh has stayed the investigation in FIR registered against Executive Engineer.
The petitioner—-Mohd Aslam Lone, presently posted as Executive Engineer PWD, R&B Division Marwah, noticed the illegal acts of a contractor of Jai Prakash Industries Limited and when confronted, the respondent took law into his hands and manhandled the petitioner and his staff for which the petitioner lodged an FIR before the Police Station Kishtwar dated 23.8. 2023 under Sections 353/504/506 IPC.
Irked by the lodging of the FIR the contractor moved the court of CJM Kishtwar and by concocting the facts of the same incident got the impugned order under Section 156 (3) against the petitioner on which the impugned FIR no. 201/2023 dated 30.8.2023 has been registered.
After hearing Advocate Aseem Sawhney, Justice M A Chowdhary issued notice to respondents and directed that subject to objections from the other side and till the next date of hearing before the bench, further investigation into the case shall remain stayed.
