HC stays operation of notices issued to schools

JAMMU, May 10: High Court today stayed the notices issued by Fee Fixation Committee to 10 private schools and issued notice to Commissioner Secretary, School Education Department, Director School Education, Jammu and Committee for Fixation of Fee Structure of Private Educational Institutions through its Chairman returnable within two weeks.
In the petition, the petitioners challenged the Government Order No. 66-Edu of 2016 dated 24-02-2016 being contrary to the orders passed by High Court in number of writ petitions including writ petition titled G D Goenka Public School and Another Versus State of J&K and others.
They have further challenged notice dated 25.4.2016 issued amongst others to the petitioners by Fee Fixation Committee requiring them to submit their reply/objections with respect to fixation of fee structure and notice No. FFC/Comp/ JMU/2016/70 dated 20.4.2016 issued to the petitioners.
The petitioners have further sought directions to the respondents to desist and refrain from bringing the fee structure of the petitioner-schools within the ambit of Fee Fixation Committee constituted by the State Government in view of petitioner-schools being registered and affiliated with Central Board of Secondary Education (CBSE) and not with the J&K State Board of School Education.
After hearing Senior Advocate Sunil Sethi with Advocates Veenu Gupta and Mohsin Bhat for the petitioners, Justice Tashi Rabstan issued notice to the State through Commissioner/Secretary School Education Department,  Director School Education, Jammu and Committee for Fixation of Fee  Structure of Private Educational Institutions of J&K State through its Chairman returnable within two weeks.
Meanwhile, subject to objections from other side and till next date before the bench, court ordered that impugned notices shall not be acted upon.
