Srinagar, Apr 16: The High Court today stayed the proceedings pending before the State Human Rights Commission with regard to terminal/retiral benefits of 126 JAKFED employees.
The Division Bench of Justice D S Thakur and Justice Rashid Ali Dar stayed the proceedings pending before the SHRC in a writ petition filed by the Secretary Cooperative Department against the Secretary Human Rights Commission.
DB issued notice to SHRC for filing of averments made in the petition and stayed the proceedings pending before the commission as the court has been informed that the issue involved in the matter is not falling within the jurisdiction of the Commission under law.
Secretary Cooperative Department through its counsel Sheikh Feroz Ahmad challenged the order passed the by Chairperson of the Commission Justice Bilal Nazki (Retd) and directed the Secretary Cooperative Department to be personally present before the Commission.
It has been submitted before the court that the proceedings before the Commission would reveal that the Commission has been interested only in seeking personal appearance of the Secretary Cooperative and not for any other purpose without considering or appreciating the detailed report submit before it.
Court has been informed that the non-release of retiral benefits in favour of the retired JAKFED employees is not intentional but due to lack of resources of the federation and their retiral benefits will be released by disposing the assets of the federation by the liquidator to be appointed as per J&K Cooperative Societies Act as and when the SAC approves the proposal of the department for winding up of federation.
